THAT Council move into closed session to consider: • litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board, related to an appeal before the Ontario Land Tribunal (OLT). Catalina Blumenberg, Municipal Clerk clarified that Council will only be moving into closed in accordance with 239 (2) (e) of the Municipal Act. • advice that is subject to solicitor-client privilege, including communications necessary for that purpose, related to legal advice related to an appeal before the Ontario Land Tribunal (OLT) Pursuant to Section 239 (2) (e) and (f) of the Municipal Act. Council reconvened in open session at 7:00 p.m. with all members present save and except Councillor Branderhorst and Councillor Roberts. Motion 2026-20 was a motion the receive a confidential report and to bring a motion forward in open session to approve minutes of settlement. Motion 2026-21 was the motion to return to open session. Reports Arising from Closed Meeting Councillor Nieman declared a pecuniary interest on item 6 pertaining to Minutes of Settlement for Draft Plan of Subdivision, Official Plan Amendment & Rezoning File No.: 13-T-21-503, OPA-05-21 & Z21-21 - 1983358 Ontario Inc. o/a Loyalist Heights -13437 Loyalist Parkway, as his daughter and son-in-law farm the parcel of land. He refrained from participating and voting on the matter.
